The Fluoride Lawsuit Against the EPA
In September 2024 a federal court found that adding fluoride to drinking water at 0.7 mg/L poses an unreasonable risk of lowering children’s IQ. Here is where the case stands, with the ruling and the reaction from IAOMT and the Fluoride Action Network.
The Federal Court Verdict Against Fluoride: Michael Connett, JD, lead attorney for the plaintiffs, at the IAOMT Spring Conference, March 2025.
Fluoride Lawsuit Ruling 2024: IAOMT’s 80-second summary of Judge Chen’s decision.
The Federal Lawsuit on Water Fluoridation: Michael Connett, JD, at the IAOMT Fall Conference in Washington, DC, September 2024.
Case Timeline:
- 2016 – 2017
The Fluoride Action Network, Food & Water Watch and other groups petition EPA under the Toxic Substances Control Act (TSCA) to end fluoridation. EPA denies the petition on Feb 27, 2017, and the groups sue in federal court in San Francisco. - June 8 – 19, 2020
First trial. Judge Edward Chen then puts the case on hold to wait for the National Toxicology Program’s review of fluoride and the developing brain. - Jan 31 – Feb 20, 2024
Second phase of the trial. EPA’s own witnesses concede that fluoride can harm the developing brain. - Aug 2024
The federal National Toxicology Program concludes that fluoride exposure above 1.5 mg/L is consistently linked to lower IQ in children. - Sept 24, 2024
Victory in court. Judge Chen rules that fluoridation at 0.7 mg/L, the level the U.S. calls optimal, poses an unreasonable risk of reduced IQ in children, and orders EPA to respond under TSCA. - Jan 17, 2025
Three days before a new administration takes office, the outgoing EPA files a notice of appeal. Its July 2025 brief does not challenge the science; it argues procedure. - Mar 3 – May 21, 2026
The Ninth Circuit hears arguments, then sets aside the 2024 judgment on a procedural point and sends the case back to Judge Chen for a new ruling on the 2020 trial record. It did not rule on the science. FAN: “FAN hasn’t lost and the EPA hasn’t won.” - Now (Oct 2026)
The case is back before Judge Chen, and FAN’s legal team is pursuing its next steps. EPA has also opened an expedited review of fluoride under the Safe Drinking Water Act.

In Their Own Words
“
Judge Edward M. Chen
U.S. District Court
“In all, there is substantial and scientifically credible evidence establishing that fluoride poses a risk to human health; it is associated with a reduction in the IQ of children and is hazardous at dosages that are far too close to fluoride levels in the drinking water of the United States.”

“
Griffin Cole, DMD
IAOMT Past President
“This unprecedented ruling is a wake-up call for the EPA, CDC and other government agencies who have, for far too long, promoted fluoridation without adequately considering its harmful effects on developing brains.”

“
Yuko Torigoe, DMD
IAOMT President
“It’s time for the EPA, CDC and other health authorities to stop ignoring the science and start protecting the health of future generations.”

Stuart Cooper
